{"id":70,"date":"2005-11-04T22:37:09","date_gmt":"2005-11-04T22:37:09","guid":{"rendered":"http:\/\/www.mathewingram.com\/work\/?p=30"},"modified":"2005-11-04T22:37:09","modified_gmt":"2005-11-04T22:37:09","slug":"sonys-bait-and-switch","status":"publish","type":"post","link":"https:\/\/mathewingram.com\/work\/2005\/11\/04\/sonys-bait-and-switch\/","title":{"rendered":"Sony&#8217;s bait and switch"},"content":{"rendered":"<p>Princeton computer science professor <a href=\"http:\/\/www.freedom-to-tinker.com\/?p=921\">Ed Felten<\/a> writes about Sony&#8217;s DRM &#8220;rootkit,&#8221; which it <a href=\"http:\/\/www.sysinternals.com\/blog\/2005\/10\/sony-rootkits-and-digital-rights.html\">installed without really telling you<\/a>, and notes that the &#8220;patch&#8221; the company provides to remove the rootkit (which Sony <a href=\"http:\/\/cp.sonybmg.com\/xcp\/english\/updates.html\">claims is harmless<\/a>) is &#8220;more than 3.5 megabytes in size, and appears to contain new versions of almost all the files included in the initial installation of the entire DRM system, as well as creating some new files. In short, they\u00c3\u00a2\u00e2\u201a\u00ac\u00e2\u201e\u00a2re not just taking away the rootkit-like function \u00c3\u00a2\u00e2\u201a\u00ac\u00e2\u20ac\u009d they\u00c3\u00a2\u00e2\u201a\u00ac\u00e2\u201e\u00a2re almost certainly adding things to the system as well. And once again, they\u00c3\u00a2\u00e2\u201a\u00ac\u00e2\u201e\u00a2re not disclosing what they\u00c3\u00a2\u00e2\u201a\u00ac\u00e2\u201e\u00a2re doing.&#8221; As <a href=\"http:\/\/blogs.siliconvalley.com\/gmsv\/2005\/11\/writing_in_free.html\">SiliconValley.com put it<\/a>: &#8220;Sorry about those secret files &#8212; what we meant to install were <i>these<\/i> secret files.&#8221; Ed also points to a commentary by <a href=\"http:\/\/blog.ericgoldman.org\/archives\/2005\/11\/sony_drm_and_tr.htm\">law professor Eric Goldman<\/a> in which he ponders whether Sony&#8217;s EULA (end user license agreement) adequately disclosed what the company was installing. If it didn&#8217;t, it could be liable for legal action.
